Health and Safety Laws

Health and safety laws help to ensure the well-being of people working in the workplace and those in the vicinity. The basis of this law is the Health and Safety at Work Act 1974. General health and safety principles are complied to and are supplemented with several regulations. While some of them are specific to certain industries, others are applicable to all kinds of industries and premises. The Health and Safety Executive (HSE) is the body that is responsible for the enforcement of this safety law.

Though it is the responsibility of the employer to analyse health and safety hazards at the workplace, it is also important for workers to communicate any safety or health issues that they might feel are or can harm them at the workplace and a solution for the problem can then be sought. For instance, there may be certain equipments provided by the employer to employees to carry out their work, but it may be possible that with time these equipment may get worn out. If the employee feels that this poses a danger to workers he/she should inform their employer of this.

In case, health and safety laws are not followed by an employer and this negligence leads to injury to an employee, the victim can sue the employer for compensation. The compensation received will include a sum for the pain and suffering experienced as well as financial losses sustained. To claim compensation it is better to seek the professional help of a personal injury Solicitor.

Pedestrian Fall from Bicycle
Miss H was knocked off her bicycle when her front tyre struck a loose paving stone jutting into the road. She sustained a head injury causing severe short term memory loss and mood swings. After 2 years her original Solicitors withdrew from the case as they believed her claim had less than a 50% chance of succeeding. Miss H contacted Cooks who agreed to represent her on a No win No fee basis.

Within 18 months the matter was resolved and Miss H received a settlement cheque of £300,000.00. She told us
"Thank you Cooks for believing in me and my claim. My Solicitor was always available to me and happy to explain each step of the process. The only surprise was how much you managed to obtain for me without the need to go to trial. I will tell all my friends about your great service."
