Skin disease claims

Occupationally induced skin disease is one of the most common industrial diseases affecting many people in the UK every year.

The majority of the instances of the problem are eczema and dermatitis, the most common being contact dermatits.

The symptoms vary according to the exact skin condition contracted and may be take the form of a rash or the skin may become itchy and sore sometimes cracking and bleeding. The condition frequently becomes chronic and can effect not only work but the quality of life of the affected individual.

There are of course many processes throughout industry which expose workers to substances which may bring about skin conditions eg. - metals, rubber, oils, cleaning agents, solvents, chemicals.

The problem of industrial skin diseases is recognised and in an attempt to reduce the risk of exposure legislation was passed in the form of "The Control Of Substances Hazardous To Health Regulations 1994". These regulations oblige employers to carry out an hazard assessment of substances to which employees may be exposed and to take steps to protect them.

Occupational skin disease can result in a compensation claim against the employer if there has been failure to protect an employee from exposure to hazardous substances. In addition to the Common Law duty of care, the above legislation places obligations on the employer and a breach may result in a claim and/or a fine.
