Common Toy Defects

If someone has been injured as a consequence of damage caused by common toy defects or other such faulty goods, the person is entitled to get product liability compensation for the injuries or damages received by him/her. The accidents are generally caused by defective toys, design defects, inadequate instructions or misleading warnings, and workmanship, may result in bigger misfortune and disaster. The compensation claim for product liability can be filed against the one who manufactures such defective and harmful toys or the one who sells these misleading goods. Small children are unsafe while playing with imperfect toys which can cause severe injuries to them.

There are a wide range of toys that are possessed with unseen common toy defects and other imperfections that cause severe injuries to the kids:

  • Some toys containing unsafe levels of poisonous lead in their surface paint such as Barbie accessories and Disney Pixar’s ‘Cars’ film, a character from Disney world, are dangerous for children.
  • Toys also include unsafe magnets in their construction that come to loose and prove fatal when swallowed down by small children. If a child unknowingly swallows two magnets at a time, magnet could get stick together and bind digestive track together with them and ultimately require a surgical operation to get it removed.
  • Small world toys include choking hazards as plastic cover including minute magnets that can cause harm to the small children.
  • Some imperfection in the manufacturing of toys may convey injuries to children while their use.

If children’s toys enclose common toy defects in them and need to be recalled, check out for the product number listed on recall notice. In case one does not find such number and is unsure about the safety of his/her child, the best way is to throw out those toys. Discard all those toys that may include unsafe parts such as lead and have choking hazards and other toxic substances. If the children are victim of any common toy defect, their caretaker should pursue a compensation claim with professional assistance. Filing a product liability compensation claim is not simple and may include very complicated procedure but it would definitely be unwise to leave the case as it is. Taking help of compensation solicitors is a good attempt in getting compensation claim against any kind of injury or damage achieved by the small children due to faulty and dangerous defective toys. Product liability can be made against either the manufacturer or seller of such defective toys.

Trip on highway
Mrs J tripped on a pothole whilst crossing a service road running parallel to a main road, fracturing her shoulder, wrist and ankle. The Council initially denied full liability for her accident alleging Mrs J was partly to blame for not avoiding the pothole. Cooks arranged a Conference with a barrister and on his advice rejected this. After intense negotiations Mrs J was awarded £17,000.00 she said:
"I had help from the start regarding my claim and found the advice very reassuring. I have never had to make a claim before so was apprehensive but you did a lot to alleviate my worries. Thanks again for all your help and support."
