Playground injury claims

Many children suffer accidents in playgrounds and fortunately, most of them are minor. However if a more serious injury occurs the child and parents may feel that compensation should be sought if they believe that the accident was the fault of the playground owner.

Whether it is a public or private playground the owner has a responsibility to ensure that the playground and equipment is safe for use. It should also be noted that a higher standard of care is required where children are concerned.

Some possible causes of accidents are :-

  1. Faulty design of equipment eg. inadequate handrails or safety barriers
  2. Faulty construction or installation of equipment
  3. Inadequate maintenance/repair resulting in defects in equipment
  4. Inadequate layout of the playground area
  5. Failure to provide soft/absorbing surface beneath playground equipment

If the accident results from negligence on the part of the playground owner/operator it may be possible to claim compensation for the child's injury. It should be noted that special considerations apply in respect of injury claims for minors (see Child Injury Claims).
