Occupational Bronchitis Claims

Employers have a legal responsibility to protect their employees from the risk of injury or disease in the course of their employment which includes avoiding exposure to harmful substances in the air.

Occupational or Industrial Bronchitis may be caused when workers are exposed to dust, fumes, gases, vapours, smoke etc. which results in inflammation of the bronchi. This can result in persistent coughing, the production of mucus and sputum and impaired lung function. Frequent attacks of bronchitis can be a cause of emphysema - damage to the air sacs within the lung.

Employers are required to to provide a safe working environment for their employees and where there is a risk of exposure to harmful substances in the they need to adopt appropriate protective measures such as ventilation systems, masks, breathing equipment.

If an employee contracts occupational bronchitis as a result of the employer's failure to prevent exposure to harmful substances then the employeee is likely to have a valid claim for compensation. It should be noted that bronchitis has a variety of causes and an essential part of the claim will be establishing that the condition has resulted from conditions in the workplace.
