Dog Bite Claims

The right to compensation is not automatic however as normally the owner will not be held responsible if the dog has not previously shown aggression or tendency to attack.

In some cases this situation is different. For instance special provisions apply to guard dogs where it is illegal to use such dogs on premises unless a warning sign is displayed. Furthermore unless there is a handler in attendance, guard dogs must be secured and not be allowed to roam the premises freely. A breach of any of these conditions would assist any claim for compensation.

Another area where compensation is likely to be payable is if certain provisions of the Dangerous Dogs Act 1991 apply. For instance under this act certain breeds of dog which are regarded as dangerous need not have displayed previous aggressive tendencies for a claim to succeed. The act also increases the liabilty of the owner of a dog which is dangerously out of control in a public place.

Dog bites can cause severe injuries in some cases and there may also be the possibility of infection caused by bacteria in the bite.
