Dermatitis Compensation Claims

Dermatitis is a skin condition which may occur naturally but, in the case of Contact Allergic Dermatitis or Contact Irritant Dermatitis, the condition results from exposure to some chemical or substance. This may be a question of the skin coming into regular contact with the substance (Irritant) or exposure to a substance to which the sufferer has developed an allergy (Allergic).

Symptoms may include the affected are of the skin becoming red, cracked, itchy or scaly and sometimes may blister or bleed. The condition may be short term but can become chronic.

Dermatitis can result from substances to which the sufferer is exposed in the workplace where the most common condition is likely to be Irritant Dermatitis. If it can be shown that the employer has not taken sufficient precautions to prevent exposure a claim for compensation may lie against him.

There are numerous chemicals and other substances in use in industry which can give rise to skin conditions. Employers have a Common Law duty to protect employees from injury or disease in the workplace and this duty has strenghened by "The Control Of Substances Hazardous To Health Regulations 1994". These regulations oblige employers to carry out assessments of the hazards of substances in use and to implement appropriate preventive measures.
